OmTree Shala Participation Agreement & Liability Waiver

1. Assumption of Risk
I understand that participating in classes and activities at OmTree at Sunflower involves physical activity that carries inherent risks, including the risk of injury, serious injury, or death. I voluntarily accept and assume all risks associated with participation, even if those risks are caused by the carelessness or gross negligence of a Released Party (as defined below) or any other person.

2. Definitions

• “Claims” include, but are not limited to, any and all liabilities, demands, legal actions, rights of action, or damages resulting from personal injury, death, or property loss connected with participation at OmTree at Sunflower.

• “Released Party” means OmTree Shala LLC and Sunflower Group Inc., its owners, affiliates, directors, officers, contractors, teachers, agents, instructors, and volunteer staff.

3. Participant Responsibility
a. I confirm that I am in adequate physical condition to participate in OmTree at Sunfower's activities. I understand that participation may result in injury, including serious injury or death.
b. I acknowledge my physical limits and agree to stop activity if I begin to feel unwell or uncomfortable.

4. Property Use
I accept full responsibility for any OmTree Shala or Sunflower Group Inc. property I use, including mats, towels, props, and other items. I agree to return them undamaged. If I fail to return borrowed or rented items, I will pay the full replacement cost and any applicable shipping or handling fees.

5. Waiver and Release
I, on behalf of myself, my heirs, next of kin, executors, administrators, and assigns, hereby waive, release, and discharge any and all Claims against any Released Party. This release applies even if the Claims result from carelessness or gross negligence.

6. Agreement Not to Sue & Indemnification
I agree not to sue any Released Party for any Claims, including those arising from carelessness or negligence. I agree to indemnify and hold harmless each Released Party from any loss or liability, including legal fees, arising from Claims brought by me or on my behalf.

7. Medical Treatment
I understand there is no obligation for OmTree at Sunflower or Sunflower Outdoor and Bike Shop or its staff to provide medical care. In the event of an emergency, if care is rendered and I am unable to give consent, I consent to that care being provided.

8. Medical Advice
I acknowledge that it is advisable to consult a physician before participating. If I have done so, I have followed my physician’s guidance.

9. No Additional Representations
No oral or written statements have been made to me about OmTree at Sunflower activities beyond what is stated in this agreement. This agreement is intended to be as broad and inclusive as permitted by law.

10. Severability
If any part of this agreement is found to be unenforceable, that part shall be severed and the remainder shall remain in full effect.

11. Shared Equipment
I understand that shared equipment may have been used by others and may carry health risks. I accept those risks if I choose to use shared equipment. I am welcome to bring my own props or mat.

12. Acknowledgment & Understanding
I have fully read and understand this agreement. I understand that by attending offerings, classes, or events, I am waiving certain legal rights that I or my representatives may have against any Released Party.
